Welcome to BrickWorks! These Terms of Service (“Terms”) govern your use of the BrickWorks mobile application, website, and related services (“Service”). By accessing or using BrickWorks, you agree to be bound by these Terms. Please read them carefully.

1. Acceptance of Terms

By accessing or using BrickWorks, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you may not use the Service.

2. Eligibility

You must be at least 13 years old to use BrickWorks. By using the Service, you represent and warrant that you meet this age requirement and have the legal capacity to enter into these Terms.

3. Account Registration and Security

To access certain features of BrickWorks, you may be required to create an account. You agree to:

  • Provide accurate, current, and complete information during registration.
  • Maintain and promptly update your information as necessary.

Some features of BrickWorks require a paid subscription. By subscribing, you agree to:

  • Pay all applicable fees and charges associated with your subscription.
  • Authorize us to charge your chosen payment method for recurring subscription fees.
  • Review and accept the subscription terms, including renewal and cancellation policies, provided at the time of purchase.

Refunds: Subscription fees are non-refundable except as required by law or as otherwise stated in our refund policy.

5. Use of the Service

You agree to use BrickWorks only for lawful purposes and in accordance with these Terms. You may not:

  • Use the Service in any way that violates applicable laws or regulations.
  • Infringe upon or violate our intellectual property rights or the rights of others.
  • Attempt to gain unauthorized access to any part of the Service, accounts, or networks.
  • Interfere with or disrupt the operation of the Service or servers.

We reserve the right to investigate and take appropriate legal action against anyone who, in our sole discretion, violates these Terms.

All content, features, and functionality on BrickWorks—including but not limited to text, graphics, logos, icons, images, software, and trademarks—are the exclusive property of BrickWorks or its licensors. You may not copy, modify, distribute, transmit, display, perform, reproduce, publish, license, create derivative works from, or sell any part of the Service without our prior written consent.

7. User Content

You retain ownership of any content you submit, upload, or display on or through BrickWorks (“User Content”). By submitting User Content, you grant BrickWorks a non-exclusive, worldwide, royalty-free license to use, display, and distribute your User Content solely for the purpose of operating and improving the Service.

You are solely responsible for your User Content and the consequences of posting or publishing it. You represent and warrant that you have all necessary rights to grant the above license.

8. Data and Privacy

Your privacy is important to us. Please review our Privacy Policy to understand how we collect, use, and protect your information. By using BrickWorks, you consent to the collection and use of your information as described in the Privacy Policy.

BrickWorks may contain links to third-party websites or services that are not owned or controlled by us. We are not responsible for the content, privacy policies, or practices of any third-party websites or services. Your use of third-party services is at your own risk.

10. Termination and Suspension

We reserve the right to suspend or terminate your access to BrickWorks at any time, with or without notice, for any reason, including but not limited to violation of these Terms. Upon termination, your right to use the Service will immediately cease, and any data associated with your account may be deleted.

11. Disclaimers

BrickWorks is provided “as is” and “as available” without warranties of any kind, either express or implied. We do not warrant that the Service will be uninterrupted, error-free, secure, or free from viruses or other harmful components. Your use of the Service is at your sole risk.

12. Limitation of Liability

To the fullest extent permitted by law, BrickWorks and its affiliates, officers, employees, agents, and licensors shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from:

  • Your use of or inability to use the Service;
  • Any unauthorized access to or use of our servers and/or any personal information stored therein;
  • Any interruption or cessation of transmission to or from the Service;
  • Any bugs, viruses, trojan horses, or the like that may be transmitted to or through our Service by any third party;
  • Any errors or omissions in any content or for any loss or damage incurred as a result of the use of any content posted, emailed, transmitted, or otherwise made available through the Service.

13. Indemnification

You agree to indemnify, defend, and hold harmless BrickWorks and its affiliates, officers, agents, employees, and licensors from and against any and all claims, damages, obligations, losses, liabilities, costs, or debt, and expenses (including attorney’s fees) arising from:

  • Your use of and access to the Service;
  • Your violation of any term of these Terms;
  • Your violation of any third-party right, including without limitation any copyright, property, or privacy right.

14. Changes to Terms

We may update these Terms from time to time. If we make significant changes, we will notify you through the app or our website. The latest version of the Terms will always be available within the app and on our website. Continued use of the Service after changes means you accept the new Terms.

15. Governing Law

These Terms are governed by and construed in accordance with the laws of the jurisdiction in which BrickWorks operates, without regard to its conflict of law principles. Any disputes arising from these Terms or the use of the Service shall be resolved in the courts of that jurisdiction.

16. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect.

17. Entire Agreement

These Terms, together with the Privacy Policy, constitute the entire agreement between you and BrickWorks regarding your use of the Service and supersede any prior agreements.
